New Exclusive Service for Hawaii Timeshare Owners to Change Title

The internet has many options to sell a Hawaiian timeshare, but has limited options to change ownership or title due to death, divorce, gifts or to fund a trust. DeedAndRecord.com is an independent service for changes of timeshare title in Hawaii.

PRLog (Press Release) - Dec 27, 2011 - Quit claim deeds are needed for timeshare ownership changes due to divorce, death, the creation of a living trust and gifting. Owners of timeshares in Hawaii face unique challenges in ownership and title change not found in other states.

Hawaii is the only state in the nation with a single statewide recording office. There are two systems of recording in the State of Hawaii. The Regular System basically serves to give “notice” that something is on record. The Regular System is similar to the recording by county found in the other states. The Land Court issues certificate of titles to owners of land. Ownership in Land Court is guaranteed by the State of Hawaii.

Each system has its own mailing address and procedures. As of July 1, 2011, the Land Court of Hawaii will not accept any document affecting timeshare ownership. Timeshare transfers must be decertified out of Land Court and recorded with Hawaii’s Bureau of Conveyances.

Documents changing title are subject to a transfer tax unless otherwise exempt. Any change in ownership must have included Form P-64b to apply for the exemption.  Deed and Record prepares both the quit claim deed and the transfer tax exemption form and submits them to the Bureau of Conveyances.  Deed and Record is a complete service.

1. Deed and Record prepares the quit claim deed, including the legal description and cover page information as required by the Bureau of Conveyances
2. Deed and Record decertifies the timeshare if it has been previously been recorded in Land Court
3. Deed and Record prepares Form P-64B to request an exemption from the conveyance tax
4. Deed and Record submits and records all documents with the Bureau of Conveyances
5. Deed and Record provides the timeshare owner with proof of recording from the Bureau of Conveyances

A quit claim deed is the most common method to change title to a living trust, transfers between spouses, and gifting.  Quit claims transfer ownership without any warranties of title or declarations of debt. Title is conveyed “as is.”

Transfers to living trusts are not a real change in ownership. The owner transfers title out as an individual to the same individual as trustee of the living trust of that individual. As both parties are the same, no real change in ownership has occurred. No escrow is needed and no warranties of valid title and outstanding debt are needed.  A quit claim deed is the most economical way to fund a trust with a timeshare.

Quit claim deeds are also the most economical method to affect transfers between former spouses due to a divorce.  All warranties of ownership and outstanding debt on the timeshare have been decided in the divorce action.  A court order has been made awarding ownership. All that is left is to transfer title by interspousal transfer deed on the public record.

Boys & Girls Clubs Of Greater Oxnard & Port Hueneme Announces New Board Members

Four community leaders have joined the Boys & Girls Clubs of Greater Oxnard and Port Hueneme’s board of directors, helping to create an expanded, more diversified board.

Four community leaders have joined the Boys & Girls Clubs of Greater Oxnard and Port Hueneme’s board of directors, helping to create an expanded, more diversified board. The new members include Stephen MacIntosh, general manager of Republic Services, Inc.; Stuart Nielson, attorney with Arnold LaRochelle Mathews VanConas & Zirbel LLP; Robert Sills, community advocate; and Police Chief Jeri Williams, Oxnard Police Department.

“Our existing board had a goal of increasing the board with community leaders from different business areas to enhance our board’s capabilities in serving our youth,” said BGCOP Chief Professional Officer Tim Blaylock. “The board has done a great job in recruiting nine impressive board members this year, many of whom are younger so our board has the benefit of different generations’ depth of knowledge.”

Board members who joined earlier this year include Ben Alaniz, Rabobank; Danielle Everson, Nordman Cormany Hair & Compton LLP; Lisa Cortez, Saalex Solutions; Laurie Eberst, St. John’s Medical Center; and Kathleen Sheehan, Port Hueneme Police Department.

The Club currently serves more than 8,500 members between the ages of 6 and 18 at its three full-service facilities, and 15 other locations in partnership with a local school district, a public housing complex and a juvenile detention center. Membership costs only $15 per year for all programs and support, and no child is ever turned away due to inability to pay. The actual cost of delivering its programs is about $500 per year, per child.

Although it was a rough start, the business has grown tremendously in a short period of time. We enjoyed our best month in November as we saw our used car business triple from the first full month of September. All departments have seen a steady incline and we are excited to see what 2012 brings.

The last three months have been a blast for Courtesy Buick GMC. We participated in many events in the community:

- Drove a pickup truck and passed out gifts and toys in the festival of lights parade in Crystal Lake
- Donated over 50 pounds of food in two oversized boxes to the 21st annual community harvest food drive in Crystal Lake
- Currently hosting a food drive for Mission Hope Chicago supplying food for our troops
- Became a member of the Crystal Lake Chamber of Commerce and attended many social functions

Those are just a few things that we have started since Courtesy landed in Crystal Lake. We are looking for much more in 2012 and would like everybody to come to Courtesy for our final sale of the year.
